Law Enforcement Guidelines

1. Overview & Purpose

TOADS LLC ("The Opposites Attract Dating Services") is committed to user safety and full cooperation with law enforcement inquiries. These guidelines provide operational instructions for law enforcement and governmental officials seeking records from TOADS LLC.

2. Legal Process Requirements

We disclose user records strictly in accordance with United States federal and state laws, including the Electronic Communications Privacy Act (ECPA), 18 U.S.C. § 2701 et seq.

• Subpoena (18 U.S.C. § 2703(c)(2)): Required to compel basic subscriber information (e.g., full name, registration timestamp, email address, IP history, and billing records).
• Court Order (18 U.S.C. § 2703(d)): Required to compel non-content transactional records and account activity logs.
• Search Warrant (Rule 41 / Federal or State Equivalent): Required to compel stored communications and private content, including chat histories and uploaded media.

3. Emergency Requests & Imminent Harm

Under 18 U.S.C. § 2702(b)(8) and § 2702(c)(4), TOADS LLC may voluntarily disclose user records to law enforcement when we believe in good faith that an emergency involving immediate danger of death or serious physical injury requires disclosure without delay.

Emergency requests must be submitted on official department letterhead signed by a sworn officer, outlining the nature of the emergency and the specific records needed.

4. Records Preservation Requests

Pursuant to 18 U.S.C. § 2703(f), TOADS LLC will preserve account records for an initial period of 90 days upon receipt of a formal written preservation request from a law enforcement agency pending official legal process.

5. Child Exploitation & NCMEC Reporting

Pursuant to 18 U.S.C. § 2258A, TOADS LLC immediately reports any detected or suspected Child Sexual Abuse Material (CSAM) and child exploitation to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and relevant law enforcement authorities.
